Terms of Service

1. About Plately

Plately ("we", "us") provides a software-as-a-service platform that lets restaurants, cafés, pubs, hotels and food businesses ("you", the "Restaurant") publish digital menus, accept QR-based dine-in orders, manage tables and billing, and view analytics. These Terms are an electronic record under the Information Technology Act, 2000 and the rules made thereunder, and do not require a physical signature.

2. Accounts & eligibility

You must be legally capable of contracting under the Indian Contract Act, 1872, and authorised to act for the Restaurant you register. You are responsible for the accuracy of your menu, prices, FSSAI-related declarations (such as veg/non-veg indicators) and for maintaining the confidentiality of your account and staff logins.

3. Subscriptions, fees & GST

Paid plans are billed monthly in Indian Rupees (INR) via our payment partner Razorpay, under an auto-pay (e-mandate) you authorise. Listed prices are exclusive of GST; GST at the applicable rate (currently 18%) is added at checkout and a tax invoice is issued for every payment. One-time onboarding fees, where applicable, are charged when you move to a paid plan and are non-refundable once onboarding has been delivered. You may cancel anytime; access continues until the end of the paid period. Downgrades take effect from the next billing cycle.

4. Refunds & cancellation

Subscription fees: if you cancel within seven (7) days of your first paid subscription payment, we will refund that payment in full. After this period, monthly fees already paid are non-refundable, but cancelling stops all future charges and you retain access until the end of the paid period. Onboarding fees: refundable in full if you cancel before onboarding work begins; non-refundable once your menu has been digitized or setup delivered. Duplicate or erroneous charges: reported within thirty (30) days will be refunded to the original payment method within 5–7 business days via Razorpay. Refunds do not apply to amounts your guests pay you for food — those transactions are solely between you and your guests. To request a refund, write to plately@thedigitalgarden.app with your registered restaurant name and invoice number.

5. Guest payments are yours

Plately is not a payment aggregator for food orders. Your guests pay you directly — cash, UPI, card or otherwise — and we never hold, route or deduct from your food revenue. Only your Plately subscription fees are processed through Razorpay. You are solely responsible for billing your guests correctly, including any GST you are required to charge on food.

6. Your content

You retain all rights to your menu, photos, logos and branding. You grant us a limited licence to host and display them to operate the service. You confirm your content does not infringe third-party rights and complies with applicable law, including food-safety and consumer-protection regulations.

7. AI menu digitization

Our AI import converts photos of your printed menu into draft menu items for your review. AI output may contain errors; nothing is published to guests until you approve it. You remain responsible for verifying names, prices and dietary marks before publishing.

8. Acceptable use & availability

You may not misuse the service, attempt to breach its security, or use it for unlawful content. We target high availability but do not guarantee uninterrupted service; planned maintenance and factors beyond our control may cause downtime. We may suspend accounts for non-payment or material breach after reasonable notice.

9. Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of the service is limited to the subscription fees you paid to us in the three (3) months preceding the claim. We are not liable for indirect or consequential losses, including lost profits or lost business.

10. Governing law & disputes

These Terms are governed by the laws of India. Subject to any mandatory arbitration or consumer-forum rights, the courts at Hyderabad, Telangana shall have exclusive jurisdiction.

Privacy Policy

This policy describes how we handle personal data in accordance with the Digital Personal Data Protection Act, 2023 ("DPDP Act") and the Information Technology Act, 2000.

1. What we collect

From restaurants: owner and staff names, email addresses, phone numbers, restaurant details, and billing information (processed by Razorpay — we do not store card numbers). From guests: when placing an order, a name and phone number provided at checkout, the table number, and order contents. Guests browsing a menu without ordering are not asked for personal data.

2. How we use it

To operate the service: delivering orders to the restaurant's dashboard, maintaining table sessions and bills, sending subscription invoices, providing support, and producing aggregated analytics for the restaurant. We do not sell personal data, and we do not use guest data for advertising.

3. Cookies & local storage

We use essential cookies for sign-in sessions, and the guest menu stores small items on the guest's own device (such as cart contents and recent order references) so their experience survives a page reload. No cross-site tracking cookies are used.

4. Sharing & processors

Data is shared only with processors needed to run the service — cloud hosting and database infrastructure, Razorpay for subscription payments, and email delivery providers — each bound by contractual safeguards. Guest order data is visible to the restaurant it was placed with. We disclose data to authorities only where required by law.

5. Storage, security & retention

Data is stored on servers located in India (Mumbai region) with encryption in transit, role-based access controls and audit logging. We retain data while your account is active and as required for tax and accounting law (for example, GST invoice records); guest order references expire from the guest's device automatically.

6. Your rights

Under the DPDP Act you may request access to, correction of, or erasure of your personal data, and may withdraw consent where processing is based on consent. Restaurants can export their menu and order data from the dashboard. Write to us at the address below; we respond within statutory timelines.

7. Grievance officer

In accordance with the IT Act, 2000 and the DPDP Act, 2023, grievances may be addressed to: Grievance Officer, Plately plately@thedigitalgarden.app. We acknowledge complaints within 48 hours and resolve them within the timelines prescribed by law.

8. Changes

We may update these Terms and this Policy from time to time. Material changes will be notified by email or a dashboard notice before they take effect.
